OVERVIEW

Welcome to DrPeps. The terms “we”, “us” and “our” refer to DrPeps. We operate this website and online store, including its information, features, products, customer accounts and related services (the “Services”).

These Terms of Service (“Terms”) explain the rights and responsibilities that apply when you access or use the Services or place an order with us. Please read them carefully before using the website.

By accessing or using the Services, you agree to these Terms. If you do not agree, you should not use the Services. These Terms operate together with any other policies published on our website, including our Privacy Policy, Shipping Policy and Return & Refund Policy.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law, or any other right that cannot lawfully be excluded, restricted or modified.

 

SECTION 1 - ACCESS, ELIGIBILITY AND ACCOUNTS

You must be at least 18 years old, or have the involvement and permission of a parent or legal guardian, to place an order.

When using the Services, you may be asked to provide information including your name, email address, phone number, billing details, delivery address and payment details. You must ensure that the information you provide is accurate, current and complete.

You are responsible for keeping your account credentials confidential and for activity carried out through your account. Please contact us promptly if you believe that your account has been used without permission. You must not transfer, sell or assign your account to another person.

 

SECTION 2 - PRODUCT INFORMATION

We aim to present product descriptions, images, specifications, pack quantities, prices and availability accurately. Colours and appearance may vary depending on your device, screen settings, lighting and product batch.

Product information may be updated when specifications, packaging, stock or other relevant details change. We may discontinue a product or limit available quantities where reasonably necessary.

Any general information published on the website is provided for product-information purposes. It is not a substitute for professional medical, legal or other qualified advice.

Nothing in this section limits any rights or remedies available under the Australian Consumer Law, including consumer guarantees relating to acceptable quality, fitness for purpose, correspondence with description and disclosed purpose.

 

SECTION 3 - ORDERS AND ACCEPTANCE

Submitting an order is an offer to purchase the products in your cart. An order is accepted when we send an order confirmation or otherwise confirm acceptance.

We may reasonably decline or cancel an order before dispatch where, for example, a product is unavailable, payment cannot be authorised, information provided is incomplete, there is an obvious pricing or description error, fraud or unauthorised activity is suspected, or fulfilling the order would breach applicable law.

If we cancel an order after receiving payment, we will refund the amount paid for the cancelled item or order using the original payment method, unless another method is agreed.

Please check your order information before submitting it. Cancellation requests are handled according to the order status and our Return & Refund Policy. We will contact you using the details supplied with the order if a material issue arises.

Products purchased through the website must not be used for an unlawful purpose or resold in breach of applicable laws or product restrictions.

 

SECTION 4 - PRICES, CURRENCY AND PAYMENT

Unless clearly stated otherwise, prices are displayed in Australian dollars (AUD). The total price, including any applicable taxes, delivery charges or other charges, will be displayed before you confirm your order.

Prices and promotions may change from time to time. A change will not affect an order already accepted, except where required by law or where an obvious pricing error is identified before fulfilment.

You must provide accurate payment and billing information and be authorised to use the selected payment method. Payments are processed through payment providers made available at checkout. Those providers may apply their own terms and privacy practices.

If an obvious pricing or system error affects an order, we will contact you and offer the option to proceed at the correct price or cancel the affected order for a refund.

 

SECTION 5 - SHIPPING AND DELIVERY

Available delivery locations, estimated processing times, delivery methods, charges and other shipping details are described in our Shipping Policy and at checkout.

Delivery dates and timeframes are estimates unless expressly stated otherwise. Delays can occur because of carriers, weather, public holidays, address issues, customs procedures or other events outside reasonable control. If we become aware of a significant delay, we will take reasonable steps to provide an update.

We remain responsible for providing the remedies required by the Australian Consumer Law where goods are not supplied within an agreed or reasonable time. Risk in the goods passes to you when the goods are delivered to the nominated address, except to the extent otherwise required by law.

You are responsible for providing a complete and accurate delivery address. Additional costs resulting from an incorrect address may be charged where permitted by law and disclosed to you.

 

SECTION 6 - RETURNS, REFUNDS AND CONSUMER GUARANTEES

Products and services sold in Australia come with automatic consumer guarantees under the Australian Consumer Law. These rights apply in addition to any voluntary warranty or store policy.

If a product does not meet an applicable consumer guarantee, you may be entitled to a repair, replacement, refund, cancellation or compensation, depending on the circumstances and whether the failure is major or minor.

We do not exclude or limit these rights. Statements such as time limits for change-of-mind returns do not restrict rights available for faulty, unsafe, incorrectly described or otherwise non-compliant goods.

Change-of-mind returns, where offered, are governed by our Return & Refund Policy. We may ask for reasonable proof of purchase and may assess an item before providing a remedy, as permitted by law.

 

SECTION 7 - INTELLECTUAL PROPERTY

The website and its content, including text, graphics, images, logos, layout, design and other materials, are owned by or licensed to DrPeps and are protected by applicable Australian and international intellectual property laws.

You may access and use the website for personal, lawful and non-commercial purposes. You must not reproduce, distribute, modify, republish, commercially exploit or create derivative works from protected content without prior written permission, except where permitted by law.

Third-party names, trade marks and materials remain the property of their respective owners. No licence or ownership right is granted except as expressly stated in these Terms.

 

SECTION 8 - OPTIONAL TOOLS AND THIRD-PARTY SERVICES

The Services may include tools, payment services, delivery services, applications or features operated by third parties. Their services may be subject to separate terms and privacy practices.

We do not control third-party services and are not responsible for their independent acts or omissions, except where responsibility cannot lawfully be excluded. You should review the relevant third-party terms before using those services.

We may add, change or remove website features where reasonably necessary. Material changes will not remove rights relating to an order already accepted.

 

SECTION 9 - THIRD-PARTY LINKS

The website may contain links to third-party websites or resources. These links are provided for convenience and do not necessarily indicate endorsement.

We are not responsible for the content, availability, security or privacy practices of independent third-party websites. If you choose to use a third-party website, you should review its terms and policies.

Nothing in this section excludes liability that cannot lawfully be excluded.

 

SECTION 10 - WEBSITE PLATFORM

Our website may use Wix and other service providers to support website hosting, ecommerce, customer accounts, payments or related functions. Purchases made through the store are transactions between you and DrPeps, not between you and the website platform provider.

Use of platform features may also be subject to the platform provider’s applicable terms and privacy practices. Nothing in these Terms releases DrPeps from responsibilities that apply to us under Australian law.

 

SECTION 11 - PRIVACY

We handle personal information in accordance with applicable Australian privacy requirements and our published Privacy Policy.

Information may be processed by service providers that support website hosting, payments, fulfilment, communications and security. Where information is handled outside Australia, we will address this in our Privacy Policy as required.

SECTION 12 - REVIEWS, FEEDBACK AND USER CONTENT

If you submit a review, comment, suggestion, image or other content (“User Content”), you confirm that you have the right to provide it and that it is accurate, lawful and does not infringe another person’s rights.

You grant DrPeps a non-exclusive, worldwide, royalty-free licence to use, reproduce and display User Content for operating, improving and promoting the Services. This licence does not transfer ownership of your User Content.

We may moderate or remove User Content that is unlawful, misleading, offensive, defamatory, infringing, contains malware or violates these Terms. We are not required to publish or respond to User Content.

 

SECTION 13 - ERRORS AND CORRECTIONS

Website information may occasionally contain typographical errors, technical issues, outdated availability information or other inaccuracies.

We may correct an error or update information when identified. If an error materially affects an order, we will contact you and provide an appropriate option, which may include confirming the corrected information or cancelling the affected item for a refund.

We will not use this section to avoid obligations or consumer rights under applicable law.

 

SECTION 14 - PROHIBITED USES

You must not use the Services:

(a) for an unlawful, fraudulent or malicious purpose;
(b) to infringe intellectual property, privacy or other legal rights;
(c) to harass, threaten, abuse, defame or harm another person;
(d) to transmit misleading information, malware, viruses or harmful code;
(e) to send spam, phishing messages or unauthorised advertising;
(f) to impersonate another person or misrepresent your identity;
(g) to scrape, crawl, probe or interfere with the website, except where permitted by law;
(h) to bypass security or access restrictions;
(i) to collect another person’s information without authority; or
(j) in any way that materially disrupts the Services or another person’s use of them.

We may take reasonable steps to restrict access where we reasonably believe these Terms or applicable law have been breached.

 

SECTION 15 - SUSPENSION AND TERMINATION

You may stop using the Services at any time.

We may suspend or terminate access to an account or feature where reasonably necessary to protect users, prevent fraud, address unlawful conduct, maintain security or respond to a material breach of these Terms.

Termination does not affect rights and obligations that arose before termination, including payment obligations, accepted orders, consumer rights and provisions intended to continue by their nature.

 

SECTION 16 - SERVICE AVAILABILITY AND DISCLAIMERS

We aim to keep the website available and information current, but uninterrupted or error-free access cannot be guaranteed. Website maintenance, security incidents, internet failures or events outside reasonable control may affect availability.

To the extent permitted by law, general website information is provided without additional warranties beyond those expressly stated. However, nothing in these Terms excludes, restricts or modifies consumer guarantees or other rights that cannot lawfully be excluded.

 

SECTION 17 - LIMITATION OF LIABILITY

To the maximum extent permitted by law, neither party is liable for indirect or consequential loss that was not reasonably foreseeable and did not arise from that party’s breach, negligence or unlawful conduct.

This limitation does not apply to liability that cannot lawfully be excluded or limited, including liability arising under the Australian Consumer Law where applicable, or liability for fraud, wilful misconduct, personal injury caused by negligence, or breach of a non-excludable statutory right.

Where liability can lawfully be limited, it will be limited only to the extent that is fair and reasonable in the circumstances.

 

SECTION 18 - INDEMNITY

You are responsible for loss reasonably suffered by DrPeps because of your unlawful use of the Services, infringement of another person’s rights, or material breach of these Terms.

This section does not require you to indemnify DrPeps for loss caused by our negligence, unlawful conduct or breach, and it does not exclude any defence or right available under applicable law.

 

SECTION 19 - SEVERABILITY

If a provision of these Terms is found to be unlawful, void or unenforceable, that provision will be read down to the extent necessary or severed where permitted. The remaining provisions will continue to operate.

 

SECTION 20 - WAIVER AND ENTIRE AGREEMENT

A failure or delay in enforcing a right does not waive that right.

These Terms and the policies expressly incorporated by reference form the agreement governing use of the Services. They do not exclude representations or rights that cannot lawfully be excluded.

 

SECTION 21 - ASSIGNMENT

You must not transfer your account or assign obligations under these Terms without our written consent.

We may assign or transfer our rights or obligations only where permitted by law and where doing so does not materially reduce your rights. We will provide reasonable notice of a material transfer where required.

 

SECTION 22 - GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of New South Wales and the applicable laws of the Commonwealth of Australia.

Subject to any rights you have to bring a claim in another jurisdiction, the courts and tribunals of New South Wales have non-exclusive jurisdiction in relation to disputes connected with these Terms.

Nothing in this section limits rights or remedies available under the Australian Consumer Law or other applicable laws.

 

SECTION 23 - CHANGES TO THESE TERMS

We may update these Terms to reflect changes to the Services, business practices or applicable law.

The current version will be published on this page with the date of the latest update. Where a change materially affects existing users or accepted orders, we will provide reasonable notice where required and will not apply the change retrospectively where doing so would unfairly reduce existing rights.

Continued use of the Services after an updated version becomes effective constitutes acceptance of the updated Terms, except where applicable law requires another form of consent.
